How You Behave in Conflict Decides What It Costs You

 

Most people think conflict is won or lost in the argument itself. It's not. It's won or lost in the record that argument leaves behind.

I have spent years watching people walk into negotiations, mediations, and courtrooms focused entirely on being right, while the other side was quietly building a case out of how they behaved along the way. Emails sent at midnight. Voicemails left in anger. A pattern of interruptions in a meeting. None of it looks like evidence in the moment. All of it becomes evidence eventually.

Behavior Is Evidence

As a Behavioral-Legal Specialist and Accredited Mediator, this is the idea my entire practice is built on. Legal outcomes are not decided only by facts and documents. They are shaped by conduct: how someone communicates under pressure, whether they escalate or de-escalate, whether their story stays consistent or shifts depending on the audience. Attorneys know this instinctively. What they often lack is a structured way to read, document, and present it.

That is the gap I work in.

Two Sides of the Same Skill

There are two directions this work runs.

The first is inward. Before you walk into a negotiation, a mediation, or a hearing, I help you see your own behavioral patterns clearly, the ones that could be misread, used against you, or simply undermine your credibility without you realizing it. Small, correctable things. A tendency to over-explain. A defensive tone that reads as guilt. These are fixable once you can see them.

The second is outward. When you are dealing with someone whose behavior has been the problem, whether that is a difficult co-parent, a business partner, or an opposing party, I help document their patterns in a way that holds up. Not opinions or impressions, but a structured, written account of conduct over time. That is the foundation of my Prove It Intensive: two focused sessions that produce a written behavioral pattern report you can actually use.

Where This Shows Up

In practice, this work takes a few different forms depending on what you need:

  • As your mediator, I sit across the table and guide the process itself.
  • As a behavioral-legal consultant, I work alongside you or your attorney on the behavioral dynamics of a case.
  • As a coach, I work with you directly on how you show up in conflict, before it costs you.
